End User License Agreement

This End User License Agreement (“EULA” or “Agreement”) governs your download, installation, access, and use of the EvaSpy software, including its Android app, Windows software, macOS software, updates, and related components (“Software”).

By downloading, installing, accessing, or using the Software, you agree to this EULA. If you do not agree to this EULA, do not download, install, or use the Software.
Your use of the EvaSpy website, online dashboard, account, subscriptions, and related services is also governed by our Terms of Use and Privacy Policy.
1. About the Software
EvaSpy is parental control and family device monitoring software for Android, Windows, and macOS devices.
The Software connects an authorized device to the user’s EvaSpy account and online dashboard. Depending on the platform, permissions, setup, selected plan, and available features, it may collect and transmit supported device activity reports to the account holder’s dashboard.
Feature availability may differ by platform, device model, operating system version, permissions, browser support, setup, and selected plan.
2. License Grant
Subject to your compliance with this EULA, the Terms of Use, and applicable law, CAPITAL PRIME LLC grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to download, install, and use the Software.
You may install and use the Software only:
- on devices covered by your account or subscription;
- on your own devices;
- on devices used by your minor child, where permitted by applicable law;
- on family-owned devices where monitoring is appropriate and properly explained;
- on devices where you have the legal right and required consent to install and use the Software.
The Software is licensed, not sold. This EULA does not transfer ownership of the Software or any related intellectual property to you.
3. Account and Subscription Requirements
Use of some or all Software features may require:
- an active EvaSpy account;
- a valid subscription or plan;
- an internet connection;
- a supported device and operating system;
- required device, browser, or system permissions;
- connection of the Software to your EvaSpy online dashboard.
The number and type of devices on which you may install the Software depends on your selected plan.
Your subscription, payments, renewals, cancellation, refunds, and account access are governed by the EvaSpy Terms of Use, Pricing page, checkout terms, and Refund Policy.
4. Permitted Use
You may use the Software only for lawful parental control, family device monitoring, your own device management, or another authorized purpose.
You may use the Software to:
- connect an authorized device to your EvaSpy account;
- enable or disable available monitoring features;
- adjust EvaSpy settings for the connected device;
- collect supported activity reports from that device;
- review available reports through your online dashboard;
- use supported blocking or monitoring features where available;
- uninstall the Software when monitoring is no longer required or permitted.
You must use the Software responsibly, transparently, and in accordance with applicable laws.
5. Responsible Use and Required Authorization
You are responsible for ensuring that you have the legal right to install and use EvaSpy on each device.
Where required by law or by the circumstances of use, you must inform the person using the device that the Software is installed and monitoring is enabled.
EvaSpy is an open monitoring tool and is not designed for hidden surveillance. The Software must not be used to secretly monitor, stalk, harass, track, or control another person.
For child devices, we recommend that parents explain monitoring in an age-appropriate way and use EvaSpy as part of clear family rules and safer digital habits.

6. License Restrictions
Except where applicable law expressly permits it, you must not:
- copy the Software except as reasonably necessary for permitted installation or backup;
- sell, rent, lease, lend, sublicense, distribute, or transfer the Software;
- share your license, account, installation files, or activation information with unauthorized persons;
- modify, adapt, translate, alter, or create derivative works from the Software;
- reverse engineer, decompile, disassemble, decode, or attempt to discover the Software’s source code;
- bypass, disable, remove, or interfere with licensing, authentication, access-control, or security mechanisms;
- remove or alter copyright, trademark, attribution, or ownership notices;
- use the Software to develop, test, improve, or support a competing product or service;
- use automated tools to extract, scrape, copy, or interfere with the Software or service;
- introduce malware, harmful code, unauthorized scripts, or security threats;
- interfere with the normal operation, performance, security, or availability of the Software;
- use the Software in a way that exceeds the device limits or other conditions of your plan.
Nothing in this EULA limits rights that cannot lawfully be excluded or restricted.
7. Prohibited Monitoring
You must not use the Software to:
- monitor another adult without their knowledge and permission;
- monitor a spouse, partner, roommate, employee, or other person without proper authorization;
- install the Software on a device you do not own or have permission to access;
- track a person or device where you do not have the legal right to do so;
- collect private information unlawfully;
- stalk, harass, threaten, intimidate, blackmail, or control another person;
- support domestic abuse, coercive control, discrimination, or other harmful conduct;
- monitor a stolen, lost, or unauthorized device;
- hide the purpose of monitoring where disclosure is required;
- violate privacy, data-protection, employment, criminal, communications, or other applicable laws;
- use the Software for any fraudulent, abusive, harmful, or unlawful purpose.
We may suspend or terminate your license and account if we reasonably believe that the Software has been used in a prohibited, unsafe, abusive, or unlawful way.
8. Installation and Device Access
You will need access to the device to download and install the Software, complete setup, grant required permissions, and connect the device to your EvaSpy account.
Installation requirements differ between Android, Windows, and macOS. You are responsible for:
- confirming that the device is compatible;
- obtaining access and authorization before installation;
- following the applicable setup instructions;
- granting required permissions;
- maintaining a supported operating system and configuration;
- keeping the device connected where necessary;
- informing the device user where required;
- uninstalling the Software when monitoring is no longer appropriate or permitted.
CAPITAL PRIME LLC does not have physical access to your device and cannot install or uninstall the Software on your behalf.
9. Permissions and Software Operation
The Software may require access to certain device, browser, accessibility, location, notification, storage, security, or system permissions to provide selected features.
The permissions required depend on the platform and enabled features.
Some features may be unavailable, incomplete, delayed, or unable to operate correctly if:
- required permissions are not granted;
- permissions are later withdrawn;
- the device is offline;
- the operating system or browser changes;
- security or battery settings restrict the Software;
- another application interferes with the Software;
- the device is unsupported or incorrectly configured.
You are responsible for reviewing and granting only the permissions appropriate for your intended and lawful use.
10. Dashboard Settings and Remote Configuration
The Software may allow the account holder to adjust available EvaSpy settings through the online dashboard.
Depending on the platform and feature, the account holder may be able to:
- enable or disable monitoring features;
- adjust feature settings;
- configure supported website or app rules;
- review connection or device status.
These functions manage EvaSpy settings and features. They do not give CAPITAL PRIME LLC general control over the device.
11. Activity Data and Privacy
The Software may collect, process, and transmit supported device activity data to the EvaSpy dashboard.
Depending on the platform and enabled features, this may include:
- app usage and active-app activity;
- installed apps;
- websites and browser activity;
- device activity and usage statistics;
- screenshots;
- screenshot text-recognition results;
- blocked app or website events;
- location history;
- call history, where supported;
- incoming SMS, where supported;
- contacts, where supported;
- internet traffic usage;
- diagnostic and synchronization information.
Not every category is available on every platform.

You are responsible for ensuring that your collection and use of monitored-device information is lawful and that any required notice or consent has been provided.
12. Updates and Changes
CAPITAL PRIME LLC may provide Software updates, patches, fixes, security improvements, new versions, or feature changes.
Updates may:
- add, modify, improve, limit, or remove features;
- correct errors or security issues;
- improve compatibility or performance;
- respond to operating-system, browser, or third-party changes;
- require new or updated permissions;
- require you to reinstall or reconfigure the Software.
You may need to install available updates to continue using the Software or certain features.
13. Beta, Preview, and Experimental Features
EvaSpy may occasionally provide beta, preview, test, or experimental features.
These features may:
- be incomplete or unstable;
- contain errors;
- change without notice;
- have limited support;
- be available only on selected platforms or accounts;
- be removed or discontinued at any time.
Beta or experimental features are provided for evaluation and should not be relied upon for critical purposes.
14. Third-Party Software and Components
The Software may include, interact with, or rely on third-party software, libraries, operating-system components, browsers, services, or open-source components.
Third-party or open-source components may be subject to separate license terms. Where required, those terms will apply to the relevant components.
This EULA does not grant you rights to third-party products or services beyond those provided by their applicable terms.
Changes to third-party platforms, operating systems, browsers, or services may affect Software compatibility and feature availability.
15. Intellectual Property and Ownership
The Software, website, dashboard, interfaces, design, code, documentation, trademarks, logos, and related materials are owned by CAPITAL PRIME LLC or its licensors and are protected by applicable intellectual-property laws.
Except for the limited license expressly granted in this EULA, CAPITAL PRIME LLC and its licensors retain all rights, title, and interest in and to the Software.
All rights not expressly granted are reserved.
Third-party trademarks, names, and logos remain the property of their respective owners.
16. Feedback
If you provide suggestions, ideas, comments, error reports, or other feedback about EvaSpy, you grant CAPITAL PRIME LLC permission to use that feedback to develop, improve, operate, promote, and support EvaSpy.
We are not required to compensate you or treat feedback as confidential unless we have separately agreed to do so in writing.
This section does not transfer ownership of your personal information or monitored-device content to CAPITAL PRIME LLC.
17. Support
Software support may be available according to your plan, the EvaSpy support terms, and available support channels.
Support may include:
- setup guidance;
- troubleshooting;
- account assistance;
- feature explanations;
- help identifying compatibility or permission issues.
Support does not include physical access to your device, general device administration, recovery of third-party accounts, or assistance with unauthorized monitoring.

18. Suspension and Termination
This EULA remains effective until terminated.
You may terminate this Agreement at any time by:
- stopping use of the Software;
- uninstalling all copies of the Software from your devices;
- closing your EvaSpy account where appropriate;
- cancelling any active subscription separately.
CAPITAL PRIME LLC may suspend or terminate your license if:
- you violate this EULA, the Terms of Use, or responsible-use rules;
- you use the Software for an unlawful or prohibited purpose;
- you fail to pay applicable subscription charges;
- your use creates a security, legal, or safety risk;
- continued access is prohibited by law or required to be restricted by a court, regulator, platform, payment provider, or other authority;
- the Software or service is discontinued.
Termination of your account or subscription may also terminate your right to use the Software.
19. Effect of Termination
When this EULA or your license ends, you must:
- stop using the Software;
- uninstall the Software from every device;
- delete any installation files or unauthorized copies in your possession;
- stop accessing licensed features.
Account deletion or subscription cancellation does not automatically uninstall the Software from a connected device.
To stop monitoring completely, you must uninstall EvaSpy from the monitored device by following the applicable Android, Windows, or macOS uninstall instructions.
Sections concerning ownership, restrictions, disclaimers, limitation of liability, indemnification, governing law, and other provisions that reasonably should survive will remain effective after termination.
20. Export Controls and Sanctions
You may not download, install, access, use, export, re-export, transfer, or provide the Software in violation of applicable export-control, sanctions, or trade laws.
You are responsible for confirming that:
- you are permitted to receive and use the Software;
- the Software will not be used for a prohibited end use;
- the Software will not be provided to a prohibited person, organization, or destination;
- your use complies with applicable United States and local laws.
CAPITAL PRIME LLC may restrict access where necessary to comply with applicable export-control, sanctions, or trade requirements.
21. Disclaimers
The Software is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, CAPITAL PRIME LLC does not warrant that the Software will:
- operate without interruption or error;
- be compatible with every device, app, browser, or operating-system version;
- capture or display every activity event;
- remain available in its current form;
- meet every user requirement;
- be completely secure.
EvaSpy is not a substitute for parental judgment, family communication, professional advice, legal advice, or emergency services.
You are responsible for deciding whether the Software is suitable for your needs and for using the information it provides responsibly.
22. Limitation of Liability
To the maximum extent permitted by applicable law, CAPITAL PRIME LLC and its owners, employees, contractors, partners, providers, and affiliates will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to:
- your installation or use of the Software;
- inability to access or use the Software;
- lost or incomplete activity reports;
- device, browser, operating-system, or compatibility issues;
- loss of data, profits, business, or goodwill;
- unauthorized or unlawful use of the Software;
- actions taken based on dashboard information.
CAPITAL PRIME LLC’s total liability relating to the Software will be limited as described in the EvaSpy Terms of Use, unless applicable law requires otherwise.
Some jurisdictions do not allow certain disclaimers or limitations, so some provisions may not apply to you.
23. Indemnification
You agree to defend, indemnify, and hold harmless CAPITAL PRIME LLC and its owners, employees, contractors, partners, providers, and affiliates from claims, losses, damages, liabilities, costs, or expenses arising from:
- your use or misuse of the Software;
- your violation of this EULA;
- your violation of applicable law or another person’s rights;
- your installation of the Software without proper authorization;
- your monitoring of a device without required notice or consent;
- information you collect, access, view, store, export, disclose, or use through EvaSpy.
24. Governing Law
This EULA is governed by the laws of the State of New Mexico and applicable federal laws of the United States, without regard to conflict-of-law principles.
Any dispute relating to this EULA or the Software will be handled in the state or federal courts located in New Mexico, unless applicable law requires otherwise.
25. Relationship to Other EvaSpy Terms
This EULA governs the license to download, install, and use the Software.
The EvaSpy Terms of Use govern broader matters including:
- account access;
- website and dashboard use;
- subscriptions and billing;
- cancellations and refunds;
- service availability;
- general user responsibilities.
The Privacy Policy explains how personal information is processed.
If this EULA conflicts with the Terms of Use regarding the Software license, this EULA will apply to that specific license issue. For all other matters, the Terms of Use will apply.

26. Changes to This EULA
We may update this EULA to reflect changes in the Software, licensing model, security requirements, business practices, or applicable law.
When we update this EULA, we will revise the “Last updated” date at the top of the page.
If a change is material, we may provide additional notice through the website, dashboard, account email, Software, or another appropriate method.
Where required by law, we may ask you to accept the updated EULA before continuing to use the Software.
27. Entire Agreement and Severability
This EULA, together with the Terms of Use and other policies incorporated by reference, forms the agreement between you and CAPITAL PRIME LLC regarding the Software.
If any provision of this EULA is found to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in effect.
A failure by CAPITAL PRIME LLC to enforce a provision does not waive its right to enforce that provision later.
You may not assign or transfer this EULA or your license without our written permission. CAPITAL PRIME LLC may assign this EULA as part of a merger, acquisition, reorganization, sale of assets, or similar transaction.
