Installatie en toegang tot het apparaat","Je hebt toegang tot het apparaat nodig om de Software te downloaden en te installeren, de installatie te voltooien, de vereiste machtigingen te verlenen en het apparaat aan je EvaSpy-account te koppelen.","De installatievereisten verschillen tussen Android, Windows en macOS. Je bent verantwoordelijk voor:","bevestigen dat het apparaat compatibel is;","het verkrijgen van toegang en toestemming vóór de installatie;","het volgen van de betreffende installatie-instructies;","het verlenen van vereiste machtigingen;","het behouden van een ondersteund besturingssysteem en configuratie;","het apparaat verbonden houden waar nodig;","het informeren van de gebruiker van het apparaat waar vereist;","het verwijderen van de Software wanneer monitoring niet langer passend of toegestaan is.","CAPITAL PRIME LLC heeft geen fysieke toegang tot je apparaat en kan de Software niet namens jou installeren of verwijderen.","9. Machtigingen en werking van de Software","De Software kan toegang nodig hebben tot bepaalde machtigingen voor apparaat, browser, toegankelijkheid, locatie, meldingen, opslag, beveiliging of systeem om geselecteerde functies te leveren.","Welke machtigingen nodig zijn, hangt af van het platform en de ingeschakelde functies.","Sommige functies kunnen onbeschikbaar, onvolledig of vertraagd zijn of niet correct werken als:","vereiste machtigingen niet zijn verleend;","machtigingen later worden ingetrokken;","het apparaat offline is;","het besturingssysteem of de browser verandert;","beveiligings- of batterij-instellingen de Software beperken;","een andere applicatie de Software verstoort;","het apparaat niet wordt ondersteund of verkeerd is geconfigureerd.","Je bent verantwoordelijk voor het beoordelen en verlenen van uitsluitend die machtigingen die passen bij je beoogde en rechtmatige gebruik.","10. Dashboardinstellingen en configuratie op afstand","Met de Software kan de accounthouder beschikbare EvaSpy-instellingen aanpassen via het online dashboard.","Afhankelijk van het platform en de functie kan de accounthouder:","monitoringfuncties in- of uitschakelen;","functie-instellingen aanpassen;","ondersteunde regels voor websites of apps configureren;","de status van de verbinding of het apparaat bekijken.","Deze functies beheren EvaSpy-instellingen en -functies. Ze geven CAPITAL PRIME LLC geen algemene controle over het apparaat.","11. Activiteitsgegevens en privacy","De Software kan ondersteunde activiteitsgegevens van het apparaat verzamelen, verwerken en naar het EvaSpy-dashboard sturen.","Afhankelijk van het platform en de ingeschakelde functies kan dit omvatten:","appgebruik en activiteit van actieve apps;","geïnstalleerde apps;","websites en browseractiviteit;","apparaatactiviteit en gebruiksstatistieken;","schermafbeeldingen;","resultaten van tekstherkenning in schermafbeeldingen;","gebeurtenissen rond geblokkeerde apps of websites;","locatiegeschiedenis;","gespreksgeschiedenis, waar ondersteund;","inkomende sms, waar ondersteund;","contacten, waar ondersteund;","gebruik van internetverkeer;","diagnostische en synchronisatie-informatie.","Niet elke categorie is op elk platform beschikbaar.","Hoe CAPITAL PRIME LLC persoonsgegevens verwerkt, staat beschreven in het {link} van EvaSpy.","privacybeleid","Je bent er zelf verantwoordelijk voor dat je verzameling en gebruik van informatie van het gemonitorde apparaat rechtmatig is en dat de vereiste kennisgeving of toestemming is gegeven.","12. Updates en wijzigingen","CAPITAL PRIME LLC kan software-updates, patches, oplossingen, beveiligingsverbeteringen, nieuwe versies of functiewijzigingen leveren.","Updates kunnen:","functies toevoegen, wijzigen, verbeteren, beperken of verwijderen;","fouten of beveiligingsproblemen verhelpen;","compatibiliteit of prestaties verbeteren;","reageren op wijzigingen in besturingssystemen, browsers of diensten van derden;","nieuwe of bijgewerkte machtigingen vereisen;","vereisen dat je de Software opnieuw installeert of configureert.","Mogelijk moet je beschikbare updates installeren om de Software of bepaalde functies te blijven gebruiken.","13. Bèta-, preview- en experimentele functies","EvaSpy kan af en toe bèta-, preview-, test- of experimentele functies aanbieden.","Deze functies kunnen:","onvolledig of instabiel zijn;","fouten bevatten;","zonder aankondiging veranderen;","beperkte ondersteuning hebben;","alleen beschikbaar zijn op geselecteerde platforms of accounts;","op elk moment worden verwijderd of stopgezet.","Bèta- of experimentele functies worden ter evaluatie aangeboden en zijn niet bedoeld om op te vertrouwen voor kritieke doeleinden.","14. Software en onderdelen van derden","De Software kan software, bibliotheken, onderdelen van besturingssystemen, browsers, diensten of opensourcecomponenten van derden bevatten, ermee samenwerken of erop steunen.","Op componenten van derden of opensourcecomponenten kunnen afzonderlijke licentievoorwaarden van toepassing zijn. Waar vereist gelden die voorwaarden voor de betreffende componenten.","Deze EULA verleent je geen rechten op producten of diensten van derden buiten wat hun eigen voorwaarden bieden.","Wijzigingen aan platforms, besturingssystemen, browsers of diensten van derden kunnen de compatibiliteit van de Software en de beschikbaarheid van functies beïnvloeden.","15. Intellectuele eigendom en eigendomsrechten","De Software, website, het dashboard, de interfaces, het ontwerp, de code, documentatie, handelsmerken, logo's en bijbehorende materialen zijn eigendom van CAPITAL PRIME LLC of haar licentiegevers en worden beschermd door toepasselijke wetgeving inzake intellectuele eigendom.","Met uitzondering van de beperkte licentie die uitdrukkelijk in deze EULA wordt verleend, behouden CAPITAL PRIME LLC en haar licentiegevers alle rechten, aanspraken en belangen in en op de Software.","Alle niet uitdrukkelijk verleende rechten zijn voorbehouden.","Handelsmerken, namen en logo's van derden blijven eigendom van hun respectieve eigenaren.","16. Feedback","Als je suggesties, ideeën, opmerkingen, foutmeldingen of andere feedback over EvaSpy geeft, geef je CAPITAL PRIME LLC toestemming die feedback te gebruiken om EvaSpy te ontwikkelen, te verbeteren, te exploiteren, te promoten en te ondersteunen.","We zijn niet verplicht je te vergoeden of feedback vertrouwelijk te behandelen, tenzij we dat afzonderlijk schriftelijk zijn overeengekomen.","Deze paragraaf draagt geen eigendom van je persoonsgegevens of van de inhoud van het gemonitorde apparaat over aan CAPITAL PRIME LLC.","17. Support","Ondersteuning voor de Software kan beschikbaar zijn afhankelijk van je abonnement, de supportvoorwaarden van EvaSpy en de beschikbare supportkanalen.","Support kan omvatten:","hulp bij de installatie;","probleemoplossing;","hulp bij het account;","uitleg over functies;","hulp bij het vaststellen van compatibiliteits- of machtigingsproblemen.","Support omvat geen fysieke toegang tot je apparaat, algemeen apparaatbeheer, herstel van accounts van derden of hulp bij ongeoorloofde monitoring.","Neem voor support contact op via {email}.","18. Opschorting en beëindiging","Deze EULA blijft van kracht totdat zij wordt beëindigd.","Je kunt deze Overeenkomst op elk moment beëindigen door:","het gebruik van de Software te staken;","alle kopieën van de Software van je apparaten te verwijderen;","je EvaSpy-account te sluiten waar dat passend is;","een actief abonnement afzonderlijk op te zeggen.","CAPITAL PRIME LLC kan je licentie opschorten of beëindigen als:","je deze EULA, de gebruiksvoorwaarden of de regels voor verantwoord gebruik schendt;","je de Software gebruikt voor een onrechtmatig of verboden doel;","je de verschuldigde abonnementskosten niet betaalt;","je gebruik een beveiligings-, juridisch of veiligheidsrisico oplevert;","voortgezette toegang wettelijk verboden is of moet worden beperkt op last van een rechtbank, toezichthouder, platform, betaaldienstverlener of andere autoriteit;","de Software of dienst wordt stopgezet.","Beëindiging van je account of abonnement kan ook je recht om de Software te gebruiken beëindigen.","19. Gevolgen van beëindiging","Wanneer deze EULA of je licentie eindigt, moet je:","stoppen met het gebruik van de Software;","de Software van elk apparaat verwijderen;","installatiebestanden of ongeautoriseerde kopieën in je bezit verwijderen;","stoppen met het gebruik van gelicentieerde functies.","Het verwijderen van je account of het opzeggen van je abonnement verwijdert de Software niet automatisch van een gekoppeld apparaat.","Om monitoring volledig te stoppen, moet je EvaSpy van het gemonitorde apparaat verwijderen volgens de betreffende verwijderinstructies voor Android, Windows of macOS.","Paragrafen over eigendom, beperkingen, vrijwaringen, beperking van aansprakelijkheid, schadeloosstelling, toepasselijk recht en andere bepalingen die redelijkerwijs zouden moeten voortduren, blijven na beëindiging van kracht.","20. Exportcontrole en sancties","Je mag de Software niet downloaden, installeren, raadplegen, gebruiken, exporteren, herexporteren, overdragen of verstrekken in strijd met toepasselijke wetgeving inzake exportcontrole, sancties of handel.","Je bent verantwoordelijk voor het bevestigen dat:","je de Software mag ontvangen en gebruiken;","de Software niet zal worden gebruikt voor een verboden eindgebruik;","de Software niet zal worden verstrekt aan een verboden persoon, organisatie of bestemming;","je gebruik voldoet aan de toepasselijke wetgeving van de Verenigde Staten en aan lokale wetgeving.","CAPITAL PRIME LLC kan de toegang beperken waar dat nodig is om te voldoen aan toepasselijke vereisten inzake exportcontrole, sancties of handel.","21. Vrijwaringen","De Software wordt geleverd “zoals het is” en “zoals beschikbaar”.","Voor zover maximaal toegestaan door de wet garandeert CAPITAL PRIME LLC niet dat de Software:","zonder onderbreking of fouten zal werken;","compatibel zal zijn met elk apparaat, elke app, elke browser of elke versie van een besturingssysteem;","elke activiteitsgebeurtenis zal vastleggen of tonen;","in de huidige vorm beschikbaar zal blijven;","aan elke gebruikersbehoefte zal voldoen;","volledig veilig zal zijn.","EvaSpy vervangt geen ouderlijk oordeel, gezinscommunicatie, professioneel advies, juridisch advies of hulpdiensten.","Je bent zelf verantwoordelijk voor de beoordeling of de Software geschikt is voor jouw behoeften en voor het verantwoord gebruiken van de informatie die de Software levert.","22. Beperking van aansprakelijkheid","Voor zover maximaal toegestaan door de toepasselijke wetgeving zijn CAPITAL PRIME LLC en haar eigenaren, werknemers, opdrachtnemers, partners, leveranciers en gelieerde ondernemingen niet aansprakelijk voor indirecte, incidentele, bijzondere, gevolg-, punitieve of exemplarische schade die voortvloeit uit of verband houdt met:","jouw installatie of gebruik van de Software;","het niet kunnen openen of gebruiken van de Software;","verloren of onvolledige activiteitsrapporten;","problemen met het apparaat, de browser, het besturingssysteem of de compatibiliteit;","verlies van gegevens, winst, bedrijfsactiviteit of reputatie;","ongeoorloofd of onrechtmatig gebruik van de Software;","handelingen op basis van informatie uit het dashboard.","De totale aansprakelijkheid van CAPITAL PRIME LLC met betrekking tot de Software is beperkt zoals beschreven in de gebruiksvoorwaarden van EvaSpy, tenzij de toepasselijke wetgeving anders vereist.","Sommige rechtsgebieden staan bepaalde vrijwaringen of beperkingen niet toe, dus sommige bepalingen zijn mogelijk niet op jou van toepassing.","23. Vrijwaring","Je stemt ermee in CAPITAL PRIME LLC en haar eigenaren, werknemers, opdrachtnemers, partners, leveranciers en gelieerde ondernemingen te verdedigen, schadeloos te stellen en te vrijwaren van vorderingen, verliezen, schade, aansprakelijkheden, kosten of uitgaven die voortvloeien uit:","jouw gebruik of misbruik van de Software;","jouw schending van deze EULA;","jouw schending van toepasselijke wetgeving of van de rechten van een ander;","jouw installatie van de Software zonder passende toestemming;","jouw monitoring van een apparaat zonder de vereiste kennisgeving of toestemming;","informatie die je via EvaSpy verzamelt, raadpleegt, bekijkt, opslaat, exporteert, openbaar maakt of gebruikt.","24. Toepasselijk recht","Op deze EULA is het recht van de staat New Mexico en het toepasselijke federale recht van de Verenigde Staten van toepassing, zonder rekening te houden met conflictregels.","Geschillen met betrekking tot deze EULA of de Software worden behandeld door de staats- of federale rechtbanken in New Mexico, tenzij de toepasselijke wetgeving anders vereist.","25. Verhouding tot andere EvaSpy-voorwaarden","Deze EULA regelt de licentie om de Software te downloaden, te installeren en te gebruiken.","De gebruiksvoorwaarden van EvaSpy regelen bredere onderwerpen, waaronder:","toegang tot het account;","gebruik van de website en het dashboard;","abonnementen en facturatie;","opzeggingen en restituties;","beschikbaarheid van de dienst;","algemene verantwoordelijkheden van de gebruiker.","Het privacybeleid legt uit hoe persoonsgegevens worden verwerkt.","Als deze EULA strijdig is met de gebruiksvoorwaarden voor wat betreft de softwarelicentie, geldt deze EULA voor dat specifieke licentieonderwerp.
